Wrongful Death Statutes
The unexpected and needless loss of a family member in an accident caused by another person’s negligence, inattention or carelessness, is traumatic and severely painful and frequently devastating to a family. In Arizona the right to pursue claims for wrongful death is governed by Arizona Revised Statutes Sections 12-611 through 12-613. There are also many published court opinions interpreting these statutes and governing wrongful death cases.
Arizona Wrongful Death Law
Arizona law allows only certain family members, or “statutory beneficiaries” to pursue a claim for the wrongful death of a loved one. Generally, the claim may be brought only by the surviving spouse, biological parents, legal guardian or one or more children of the deceased. The calculation of monetary damages for each statutory beneficiary is very subjective and varies a great deal from case to case. The following factors may be considered by a jury: the nature of the relationship between the family member and the deceased loved one, the severity of pain, grief, sorrow, stress and mental anguish that the family member has and will continue to endure in the future from the death, the value of income and services that the family member has lost and will continue to lose as a result of the death of the loved one, the reasonable expenses of funeral and burial, and the reasonable expense of necessary medical care for the injuries that resulted in the demise of the loved one.
